2.  Quotations and Contracts

All quotations issued by us are valid for 30 calendar days from the date stated unless explicitly extended in writing. A formal and legally binding agreement is only established upon written acceptance of our quotation by the client and written confirmation from us. Any modifications to the originally agreed scope of work must be documented and approved in writing by both parties, and such amendments may result in additional charges, which will be outlined in an updated agreement or variation order.

3.  Client Responsibilities

Clients engaging CJB Piling Ltd must:

  • Provide detailed, accurate, and timely information regarding the site, including access points, topographical features, and potential hazards.
  • Obtain all relevant planning permissions, party wall agreements, and regulatory approvals, where necessary, in advance of the start date.
  • Ensure the worksite is free from obstruction, properly accessible, and secure for the commencement and ongoing progress of the work.
  • Provide safe and uninterrupted access to necessary site utilities, including but not limited to water, electricity, and drainage.
  • Notify us of any underground services or structural vulnerabilities that could affect the safe execution of the project. Failure to meet these responsibilities may result in avoidable delays, increased project costs, or possible suspension of work.

4.  Payment Terms

Unless specifically agreed otherwise in a signed document:

  • An initial deposit is typically required to confirm the project schedule and facilitate the ordering of essential materials.
  • Payments will be due in structured stages based on the progress and completion of defined project milestones.
  • The remaining balance must be cleared in full within 14 days from the date of the final invoice.
  • In cases of late or non-payment, we reserve the right to suspend further work and apply interest on overdue amounts at a rate of 4% above the Bank of England base rate until payment is received.

5.  Health & Safety

Health and safety are critical elements of our operational standards. CJB Piling Ltd strictly complies with all applicable UK health and safety regulations and expects the client and all individuals present on site to do the same. Should any safety concerns arise, our team will address them immediately. We reserve the right to pause or cease operations if a serious risk to health and safety is identified. Clients must not enter active work areas unless authorised and accompanied by site management.

6.  Delays and Force Majeure

Although we endeavour to complete all projects on schedule, we shall not be held accountable for delays caused by circumstances beyond our reasonable control. These include, but are not limited to, adverse weather conditions, material or equipment shortages, supply chain disruptions, labour disputes, civil unrest, government directives, or unforeseen technical challenges. In the event of such circumstances, we will keep the client informed and propose an adjusted timeline in good faith.

7.  Warranties and Liability

We warrant that all works will be performed with due skill, care, and compliance with industry best practices. CJB Piling Ltd’s liability with respect to any claim shall be limited to the total contract value. We are not liable for indirect, consequential, or special damages, including, but not limited to, project delays due to other contractors, business interruption, or reputational harm. Defective workmanship reported within the agreed warranty period will be investigated and resolved without additional charge where appropriate.

8.  Insurance

CJB Piling Ltd maintains up-to-date public liability insurance and employer’s liability insurance to safeguard our clients, third parties, and personnel during all phases of project delivery. Copies of insurance documentation are available for client review upon reasonable request. Insurance coverage is reviewed annually to meet evolving industry standards and legal requirements.

9.  Intellectual Property

All original content, written materials, designs, and visuals hosted on our Website or included in our proposals remain the intellectual property of CJB Piling Ltd or our licensed partners. Clients and visitors are prohibited from copying, replicating, modifying, or disseminating any of our content for commercial or non-commercial use without obtaining explicit written permission.

10.  Termination

Either party has the right to terminate the agreement with written notice if the other party commits a substantial breach of contract that remains unresolved within 14 days after written notice. Upon termination, the client must pay for all completed work and any associated materials that have been ordered or fabricated. We reserve the right to recover reasonable administrative and legal costs in the case of wrongful termination or unresolved disputes.

11.   Subcontractors

We reserve the right to engage suitably qualified subcontractors to carry out specific portions of the work. All subcontractors are managed by CJB Piling Ltd and are required to meet our quality, safety, and performance standards.

12.  Electronic Acceptance

Acceptance of quotations, contract terms, or amendments via email or electronic signature shall be regarded as legally binding and enforceable. Digital confirmations are accepted in lieu of handwritten signatures unless otherwise stipulated.

13.  Dispute Resolution

In the event of a dispute, both parties agree to attempt resolution through good-faith negotiation. If a resolution cannot be reached, either party may suggest formal mediation prior to initiating legal proceedings. This clause does not restrict either party’s right to seek urgent injunctive or equitable relief.
